Recent Accomplishments


Obtained recovery from former employee who brought wage and hour class action alleging managers were misclassified as exempt employees.  Established that employee was involved in theft from employer and negotiated repayment of stolen amounts.  Class action allegations were also dismissed. 

Successfully obtained dismissal of case early in litigation for Southern California client by winning a motion to strike and demurrer to complaint.  The case involved various causes of action against the company and individual owners including, wage and hour claims for unpaid overtime, missed meal and rest breaks, and violation of California's WARN Act.

Tried four-day arbitration for claims brought by two employees against franchisee for national restaurant chain for California Labor Code violations.  Obtained defense verdict against one plaintiff, and limited recovery to under $1,000 for the other plaintiff.  At the start of the case, the team successfully compelled arbitration and had class action claims dismissed, which drastically limited the potential liability of the case.  After completion of arbitration, won motion to dismiss remaining Private Attorney General Act representative claims, and then successfully moved to recover costs based on win. 

Prevailed in reported decision in Southern District of California on motion to compel arbitration and stay class action arising under FLSA and California Labor Code claims, compelling arbitration on individual basis and staying entire case pending determinative Supreme Court decision.

Successfully brought a motion to dismiss wage and hour class action at beginning of litigation for allegations that Los Angeles based restaurant chain did not provide pay checks within time limits set by Labor Code.

Defeated motion for class certification for national manufacturing client involving allegations of missed meal and rest breaks, unpaid commissions, and off-the-clock work. 

Prepared defense for exempt misclassification case for trial for national solar and wind power supplier; obtained favorable settlement two days prior to trial after court issued favorable rulings on pre-trial motions.
